Terms of Service

These terms are the deal between you and Humpday Media (operating Kontagion). The headline, plainly: your film is yours, we take only the license we need to run the product, you pay for what you use, and you don't use the suite to hurt people. By creating an account or using Kontagion you agree to these terms and to our Privacy Policy.

01Acceptable use

Kontagion is for making films and the work around making films — writing, planning, editing, reviewing, and delivering them, alone or with your collaborators. You may not use it to:

  • Break the law, or generate content that does — including content that sexualizes minors, that constitutes targeted harassment, or that's designed to defraud.
  • Generate deceptive media of real people without their consent — no non-consensual deepfakes, impersonation, or synthetic "evidence."
  • Infringe other people's copyrights, trademarks, or rights of publicity.
  • Probe, overload, or interfere with the service, other users' projects, or the providers behind the AI operations.
  • Resell, scrape, or bulk-extract the service or its generated output as a data product.

AI generation runs through third-party providers with their own content rules; a generation they refuse is a generation we can't deliver.

When a generation uses a real person's likeness — a reference photo or a saved identity set — we'll ask you to confirm you have the rights and consent to depict that person before we create it. That confirmation doesn't transfer responsibility to us: you remain responsible for having the permissions you attest to.

02Your account

You need an account to use Kontagion. Keep your credentials to yourself; what happens under your account is your responsibility until you tell us it's been compromised. You must be at least 13 (or the higher minimum your jurisdiction sets) and able to form a contract. One person per account; teams share through the collaboration features, not shared passwords.

03Your content is yours

Kontagion claims no ownership of your work. Your screenplays, footage, timelines, exports, and everything you generate inside the product belong to you. To the extent AI-generated material is capable of ownership in your jurisdiction, we assign any interest we might have in it to you. Note that the copyright status of purely AI-generated material varies by jurisdiction and isn't ours to guarantee.

04The license you grant us

To run the product we need your permission to handle your content. You grant Humpday Media a limited, non-exclusive, revocable license to store, transmit, render, process, and display your content — solely to operate, debug, and improve the service for you, including passing the specific pieces described in the Privacy Policy to the providers that fulfill the operations you request. The license ends when you delete the content or your account, except for backup-rotation lag and what law requires us to keep. It is never a license to train models on your work or to use your film for our marketing without asking.

05Payment & refunds

Paid plans and credit packs are billed through Stripe at the prices shown at checkout. Credits are consumed by AI operations as disclosed in the product; spend caps warn at 80% and stop at 100% so you can't be surprised. Subscriptions renew until cancelled — cancel any time and keep access through the period you paid for. Unspent purchased credits are refundable within 30 days. Credits already spent on completed generations are non-refundable (the providers charge us either way); failed operations are restored automatically. For billing-page discrepancies or anything that feels wrong, email info@kontagion.com — we'd rather fix it than argue.

06Termination

You can stop using Kontagion and delete your account whenever you like. We can suspend or terminate accounts that violate these terms, create legal risk, or abuse the service — with notice and a chance to export your work except where the violation makes that irresponsible. If we ever discontinue the service, we'll give you reasonable notice and a window to export everything.

You represent that you are not located in, ordinarily resident in, or acting for a jurisdiction or person with whom U.S. law prohibits us from doing business, and that you are not a blocked or denied party. You may not use Kontagion for a prohibited end use or to evade trade restrictions. We may refuse or suspend access where required by law.

07Copyright complaints (DMCA)

If you believe content on Kontagion infringes your copyright, submit a structured takedown notice. It asks for identification of the work and material, locations, contact details, the required good-faith and perjury statements, authorization, and an electronic signature. We promptly review complete notices and may remove or disable access to the identified material while notifying the affected account holder.

If your material was removed because of mistake or misidentification, use the same copyright intake to submit a counter-notification. A complete counter-notice must include the original notice reference, your contact details and physical address, identification and former location of the material, the required good-faith and perjury statements, consent to the appropriate federal court's jurisdiction, acceptance of service, and your signature. We may restore the material as permitted by law unless the original claimant tells us it has filed a court action.

We record infringement strikes only after human review of a valid notice—not merely because an allegation was submitted. Accounts with multiple valid infringement determinations may be suspended or terminated, taking counter-notices, retractions, and the surrounding circumstances into account. Public shared-content pages provide an in-product report control that sends notices directly to our moderation queue. General abuse reports can also be sent to info@kontagion.com.

08Disclaimers

Kontagion is provided "as is." We work hard on reliability, but we don't warrant that the service will be uninterrupted, error-free, or that AI output will be accurate, fit for your purpose, or clear of third-party rights — review what the models give you before you put it in your film. During beta, features may change or be withdrawn. Nothing in the product is legal advice, including Kyger's opinions about your festival strategy.

09Limitation of liability

To the maximum extent the law allows, Humpday Media's total liability for any claims arising out of the service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Some jurisdictions don't allow some of these limits; where that's you, they apply only as far as permitted. Keep local copies of source footage you can't afford to lose — we run backups, but your masters deserve more than one home.

10Indemnification

If your content or your use of the service in violation of these terms gets us sued — for example, footage you didn't have rights to, or a deepfake you weren't permitted to make — you agree to defend and indemnify Humpday Media against the resulting claims, damages, and reasonable legal costs. We'll notify you promptly and let you control the defense where appropriate.

11Governing law

These terms are governed by the laws of the United States and the Commonwealth of Virginia, without regard to conflict-of-law rules, and disputes belong in the state or federal courts located in Virginia, which both of us consent to. If a court finds part of these terms unenforceable, the rest stands.

12Changes to these terms

When these terms change materially we'll update the effective date and notify signed-in users in the product before the change applies. Continuing to use Kontagion after that means you accept the new terms; if you don't, export your work and close your account — no hard feelings.
